These Terms of Service (the "Terms") are an agreement between you and Splitwork LLC, a Kansas limited liability company ("Splitwork," "we," "us," or "the app"), which operates Splitwork, a running-training application that builds adaptive training plans for individual runners. By creating an account or using Splitwork, you agree to these Terms. If you do not agree, please do not use the app.
You must be at least 18 years old to use Splitwork. By creating an account, you represent that you are at least 18. We do not knowingly collect data from anyone under 18; if we learn that we have, we will delete it. You are responsible for the accuracy of the information you provide, for all activity under your account, and for keeping your login credentials secure. Let us know promptly if you believe your account has been accessed without your permission.
Splitwork generates running-training plans and related tools based on the goals and run data you provide, and adapts those plans over time. The plans, paces, and workouts are informational guidance produced by our adaptive training engine — they are not personalized coaching, and they are not medical advice (see Section 7).
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Splitwork for your own training. All rights we do not expressly grant are reserved.
To keep Splitwork working and protect our work, you agree that you will not, and will not allow anyone else to:
Splitwork — including its software, design, text, graphics, the Splitwork name and logo, and all related intellectual-property rights — is owned by us and protected by law. These Terms do not transfer any ownership to you.
You keep ownership of the run and training data you provide. You grant us a limited license to store and process that data solely to operate and improve the app for you. We do not sell your personal data. How we handle your data is described in our Privacy Policy and, for health-related data, our Consumer Health Data Privacy Policy.
Splitwork is not a medical provider and does not give medical advice. Consult a physician before beginning or changing any training program, especially if you have any health condition, injury, or concern. Running and exercise carry inherent risks, including the risk of injury. You participate at your own risk and are solely responsible for your training decisions, your pacing, and listening to your body.
Assumption of risk and release. You knowingly and voluntarily assume all risks associated with using Splitwork's training plans and with any physical activity they suggest. To the fullest extent permitted by law, you release and hold harmless Splitwork LLC and its members, managers, and affiliates from any and all claims, liabilities, or damages arising out of or relating to your use of the app or your participation in any activity it suggests, including claims based on ordinary negligence. This release does not apply to liability that cannot be waived under applicable law, including gross negligence or willful misconduct.
Training paces and plans are estimates generated from the data you provide; they are not guaranteed to be appropriate for you on any given day or in any given conditions.
Some features may be offered on a paid subscription. If you purchase a subscription, we disclose the price, billing period, and renewal terms clearly and conspicuously at checkout before you enter payment details, and you authorize recurring charges until you cancel.
Free trial. Where a free trial is offered, we show you its length and the exact date and amount of the first charge before you enter payment details. You will not be charged if you cancel before the trial ends. Once the trial converts and your card is charged, that charge is for the billing period that follows.
How to cancel. You can cancel at any time — in about the same few steps it took to subscribe — from Settings → Splitwork plan inside the app. Cancellation takes effect at the end of your current billing period, and you keep full access until then.
Refund Policy. Splitwork is billed in advance on a subscription basis.
This policy does not limit any non-waivable rights you have under applicable law. We will give notice of any material change to pricing.
Splitwork can connect to third-party services such as Strava and Garmin. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or fit for a particular purpose.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury arising from your use of the app. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty U.S. dollars ($20).
To the fullest extent permitted by law, you agree to indemnify and hold harmless Splitwork LLC and its members, managers, and affiliates from and against any third-party claims, liabilities, damages, and reasonable costs (including attorneys' fees) arising out of your violation of these Terms, your misuse of the app, or your violation of any law or the rights of another person in connection with your use of the app. This does not apply to claims arising from our own gross negligence or willful misconduct.
We love hearing from runners, and the app includes ways to send us feedback and suggestions. If you do, you agree that we may use your feedback freely — to fix, improve, or build features — without any obligation to credit or compensate you. Feedback does not include your personal run data, which remains yours under Section 6.
You may stop using Splitwork at any time. We may suspend or terminate your access if you violate these Terms or use the app in a way that could harm us or other users. Sections covering intellectual property, the restrictions in Section 4, health and release (Section 7), disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.
We may update these Terms as the app evolves. Material changes will be reflected by the "last updated" date above, and your continued use of the app after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Kansas, United States, without regard to its conflict-of-laws rules.
Talk to us first. If you have a dispute with us, you agree to contact us at the email below and give us 30 days to try to resolve it informally before filing any claim. Most issues can be fixed with an email.
Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sedgwick County, Kansas, and you consent to the personal jurisdiction of those courts. Either party may instead pursue an eligible claim in small-claims court.
These Terms, together with the policies they link to, are the entire agreement between you and Splitwork about the app. If any provision of these Terms is found unenforceable, the rest remain in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, and will require any successor to honor them. We are not liable for delays or failures caused by events beyond our reasonable control.
